Odyssey marine exploration found the treasure in a Spanish ship off the coast of Portugal in 2007.
Spain successfully argued in court that it never relinquished ownership of the ship or its contents.

Well, did they really think they were going to be able to keep it? That's the Golden Rule of Shipwrecks....the country the ship belongs to generally gets the spoils. There was a wreck of a War of 1812 British Marines ship found in Lake Ontario (by Americans) off Sacketts Harbor NY a few yrs ago & from the get-go it was reported that any *treasure* rightfully belonged to the UK. Eventually they decided not to disturb it much b/c it had sunk w/ all hands aboard & was considered to be the equivalent of a military graveyard, so not worth shifting remains for a few military artifacts.

I read a few months ago where one of the US war ships was found and the article stated because it was a war ship all booty belonged to the US. I got the impression that only because it was a war ship was the reason for that rulling.

it looks like another nation (Peru) has filed a claim:
TAMPA, Fla. (AP) - Peru's government filed a long-shot claim on Thursday for 17 tons of silver recovered from a 19th century shipwreck, one day before Spanish military planes were to fly the treasure out of a U.S. Air Force base.
Peru's last-minute emergency appeal to the U.S. Supreme Court urged the justices to block transfer of the treasure to give that South American nation more time to make arguments in federal court that it is the rightful owner. Peru says the gold and silver was mined, refined and minted in that country, which at the time was part of the Spanish empire. The appeal was directed to Justice Clarence Thomas, who did not indicate when he would respond.

Odyssey has said in earnings statements that it has spent $2.6 million salvaging, transporting, storing and conserving the treasure. But it is not expected to receive any compensation from the Spanish government for recovering it because the European nation has maintained that the company should not have tried to do so in the first place.
If Odyssey did not attempt and succeed in recovering the treasure, the Spanish government would not have this extra booty to fill their coffers. I believe most of it should go back to the originating country, but do you really think the Spanish government would have kept the treasure buried if they found it? Odyssey did the work that the Spanish government would have had to pay for themselves. I think Odyssey should receive something for their successful efforts in salvaging the treasure for the Spanish government to use.
